The TERMS OF USE ("TOU") is a legal agreement between you (either as an individual or any other legal entity) ("You" or "Your" or "the client"), Blaze Concepts ("Blaze Concepts") and the parent company Blaze Technologies Ltd ("Blaze Technologies"). Your access to, and use of Blaze Technologies websites ("Website") and the services provided is subject to, and governed by, these TOU. Be sure to carefully read and understand all of the rights and restrictions delineated in these TOU. For Your reference, You may print the TOU by using the "Print" option on your browser. By accessing the Website, you confirm your agreement to and acceptance of these terms. Blaze Concepts reserves the right to update the TOU at any time without notice. 1.1 Blaze Concepts has the right, but not the duty, to terminate or suspend Your access to the Website, without notice, for any conduct that Blaze Concepts, in its sole discretion, believes is in violation of any applicable law or is harmful to the interests of another user, a third-party provider, a service provider or Blaze Concepts. Blaze Concepts makes no representation that the information contained in the Website is appropriate or available for use throughout the world. It is forbidden to access the Website from territories where the legislation provides that the content or use of the Website is illegal. You choose to use the Website on Your own initiative, and it is Your responsibility to ensure that You conform to all applicable local laws.

2.5 We will endeavour to take all reasonable steps to keep secure any information, which we hold about you, and to keep this information accurate and up to date. Your information is stored on secure servers that are protected in controlled facilities. Our hosting providers and data processors are obliged to respect the confidentiality of any personal information held by Blaze Concepts. However, as we cannot guarantee the security of communications over the Internet, we cannot give an absolute assurance that your information will be secure at all times. Blaze Concepts will not be held responsible for events arising from unauthorized access to your personal information.
2.6 Blaze Concepts may provide links to web sites outside of the Blaze Concepts site. These linked sites are not under the control of Blaze Concepts, and we are not responsible for the conduct of companies or organisations linked to our web site. Before disclosing your personal information on any other web site, we advise you to examine the Terms and Conditions of those web sites.
2.7 UNDER THE FREEDOM OF INFORMATION ACT ("FOI") YOU MAY HAVE A LEGAL RIGHT TO A COPY OF ALL THE PERSONAL DATA ABOUT YOU HELD BY BLAZE CONCEPTS. IF YOU WISH TO OBTAIN A COPY OF PARTICULAR INFORMATION PROVIDED TO BLAZE CONCEPTS, OR IF YOU BECOME AWARE THE INFORMATION IS INCORRECT AND YOU WOULD LIKE US TO CORRECT OR DELETE IT, CONTACT US AT ADMIN[at]BLAZECONCEPTS.CO.UK AND WE WILL RESPOND TO YOUR REQUEST WITHIN 5 BUSINESS DAYS.
2.8 In the event Blaze Concepts conducts a business transition, such as a merger, acquisition by another company, or sale of all or a significant portion of its assets, your personally identifiable information (Personal Data) will likely be among the assets transferred. You will be notified via email or prominent notice on our Web site for 30 days of any such change in ownership or control of your Personal Data.
2.9 Blaze Concepts reserves the right to change, modify or update this statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you here by means of a notice on our home page.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF THE SERVICE AND ARE NOT RELYING ON ANY REPRESENTATION AGREEMENT, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
3.1 We reserve the right to refuse to construct a web site which we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK laws.
3.2 The acceptance of a commission shall be deemed as a contractual agreement between the client and Blaze Concepts and agreement to the terms and conditions herein.
3.3 For larger commissions as defined by Blaze Concepts, a payment of 25% of the full charges are due prior to starting work on a project. A further payment of 50% is due at the time of production of a ’beta’ version for final content edits. The balance of 25% will be due the time of launch, as defined in the project proposal and specification. For individual projects or bodies of work Blaze Concepts may vary the payment terms as necessary. Any variation in payment terms will be clearly stated in the quotation for the body of work. Variation to the payment terms do not affect the remaining terms and conditions as described in the rest of this document.
3.4 Blaze Concepts cannot always guarantee to start work immediately on a commission but will arrange a date with the client as to when work can commence. Delivery schedules for work where required will be defined in the specification for the commission but Blaze Concepts accepts no responsibility for delays caused by suppliers or contributors including, but not limited to, contributions that are to be made by the client. If a delivery schedule is not explicitly stated in the specification then Blaze Concepts will deliver the commissioned body of work within a reasonable time according to the amount of work necessary to complete the commission.
3.5 Blaze Concepts will produce a detailed proposal and specification for the commission in collaboration with the client. When engaging the services of Blaze Concepts the proposal and specification is deemed to be the full body of work to be completed. If, following approval of the specification and during the Website Development Cycle the client wishes to make changes to the specified work then Blaze Concepts will produce a revised quotation that defines any extra charges to be incurred. Acceptance of this further quotation will be taken as agreement to commission a separate body of work from that defined in the original proposal and will not supersede or cancel the original agreement except when explicitly stated.
3.6 All material, both text and images, supplied by the client will remain the client’s property. The client is responsible for securing all necessary licenses or permissions for content that is supplied to Blaze Concepts. All such material supplied by the client will be assumed to be the property of the client and therefore free to use in any development without fear of breach of copyright laws.
3.7 The copyright for all material provided by Blaze Concepts, such as code, graphics, photographs, images and text, will remain the property of Blaze Concepts until such time as payment has been made in full whereupon they will become the property of the client.
3.8 Blaze Concepts makes every effort to design the pages which display acceptably in standards compliant browsers to the standard moderated by the World Wide Web Consortium automatic validation tools for HTML, XHTML and their variants, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.
3.9 If a client wishes Blaze Concepts to promote a web site as a separate commission, Blaze Concepts will make every reasonable effort to promote the website effectively but cannot guarantee a high placing in search engine results.
3.10 Blaze Concepts can accept no responsibility or liability if any search engine, online directory or search site does not index the web site fully or display the web site in search results.
3.11 Blaze Concepts will initially place the client’s website on one of Blaze Concepts’ demonstration servers during the Website Development Cycle so that the client may view the website’s progress. When both Blaze Concepts and the client agree that the website meets the criteria agreed during the commissioning process, Blaze Concepts will invoice the client for the full amount due for the commission. On receipt of payment, Blaze Concepts will publish the website on the client’s server, or provide the source code for the site via a download (or cd-rom disk) for the client to upload.
3.12 If at any point during the Website Design / Development Cycle a client wishes to cancel, they may do so but will be invoiced an amount that Blaze Concepts in it’s sole judgment deems to be appropriate for the amount of work completed on the commission up to the point of cancellation. Blaze Concepts will make every reasonable effort to supply the work done to the point of cancellation immediately following receipt of all outstanding payments. Blaze will charge a reasonable fee for any extra time spent in transferring the work already completed to the client or any person or persons nominated by the client and include these in a final invoice prior to transfer of files. Blaze will not be liable for support or further services to the client or their nominees unless arranged by agreement.
3.13 If, during the Website Development Cycle, the client does not supply the content required in order to complete the commission within a reasonable amount of time (14 days), Blaze Concepts will consider that the client wishes to cancel the commission. Paragraph 3.12 will then apply.
3.14 All invoices are due by return within a maximum of 14 days unless stated otherwise.
3.15 Quotations for services will be valid for one calendar month from the date of issue. The cost of goods and materials may fluctuate to reflect any changes imposed by our suppliers. All quotations are excluding VAT which will be applied at the rate applicable at the time invoices are raised.
3.16 Any payment returned by the bank or credit card company will incur a £50 administration charge. This will be invoiced and will be added to the total outstanding debt owed by the client.
3.17 Any late payments made in relation to amounts owing to Blaze Concepts that are received outside the 14 day invoicing period will be subject to an administration fee of £50 in respect of each reminder letter or email sent. In addition interest at 12.5% per annum will be added. If any additional administration work or outside agency is used in collecting the debt then these costs will be added to the account.
3.18 Blaze Concepts does not undertake to maintain or update a client’s website as part of the design commission. If a client wishes Blaze Concepts to maintain or update a web site as a separate commission, Blaze Concepts will negotiate with the client a maintenance contract appropriate to the amount of work required. Web site maintenance may also be undertaken on a time and materials basis if the client so wishes.
3.19 Blaze Concepts reserves the right to alter prices at any time without notice. If a client has commissioned any services from Blaze Concepts prior to a change in prices, that commission will not be subject to any increase, but any subsequent commission may be subject to an increase.
3.20 By agreeing to these terms and conditions your statutory rights are not affected.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF THE SERVICE AND ARE NOT RELYING ON ANY REPRESENTATION AGREEMENT, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
4.1 Blaze Concepts makes the use of Search Engine Optimization (hereinafter SEO), offered exclusively under the currently valid Consultancy Terms and Conditions, available to clients who have entered into a so-called Consultancy Agreement. Any divergent General Terms and Conditions of the client, regardless of its location, shall not be a component part of this agreement. Ancillary agreements shall be component parts of the agreement only if they have been confirmed by Blaze Concepts in writing or by fax.
4.2 The term "Search Engine" means search engines, meta-search engines, Internet search functions within directories, and the search functions of other Internet services that enable searches within databases that index the contents of the Internet. The term "Search Term" means individual words as well as word combinations or phrases, regardless of the language used.
4.3 Unless agreed otherwise, the minimum term of the respective agreement for SEO shall be six (6) months. In the event of delays for which Blaze Concepts is not responsible, the minimum term shall be extended accordingly.
4.4 Upon expiration of the minimum term, the agreement shall be extended for an indefinite term if one of the parties has not given notice of termination at least four (4) weeks prior to expiration of the minimum term. After expiration of the minimum term, either party can give notice of termination two weeks before the end of the calendar month at any time and without stating any reason for such termination.
4.5 Notices of termination must be made in writing, which in this case shall be satisfied by fax or email. Notices of termination via email that are addressed to Blaze Concepts must be sent to the relevant email address.
4.6 Blaze Concepts does not guarantee that any optimized web pages will achieve any particular position in search engine results at any particular time for particular search terms. There can also be no guarantee that optimized web pages will be registered by search engines or included in databases. Blaze Concepts makes express reference to the fact that it is possible that optimized web pages will not be accepted by search engines. While all techniques used for optimization by Blaze Concepts are designed so to achieve acceptance by search engines and databases, the mechanism for evaluating pages on the Internet by search engines is constantly changing so that optimized pages can be evaluated as conscious manipulation of search engines and therefore possibly rejected. Blaze Concepts will continuously adapt its optimization techniques to the best of its knowledge to the conditions of the Internet.
4.7 To increase link popularity, links to other sites on the Internet may be integrated into the clients optimized documents. The goal is to increase the link popularity of all clients by expanding mutual linking. The client gives its explicit consent to the use of this process on its domains that are employed within the scope of optimization.
4.8 The client shall have no claim to re-optimization free of charge during the term of the agreement; regular maintenance of documents during the term of the agreement shall remain unaffected.

5.1 All our corporate and logo designs are created by Blaze Concepts graphic designers. Any similarity to other existing logos or trademarks is purely accidental unless otherwise directed by the client. We do not accept any liability for the rejection of a trademark application, or any infringement or violation of intellectual property right asserted by a third party in relation to our products.
5.2 Upon the completion of your corporate design package, you gain copyright ownership of the design. However you agree to allow us royalty-free, perpetual, irrevocable, sub-licenseable rights to publish your design or any other work we do for you in any media as part of our portfolio or any other promotional material.
5.3 Corporate logos will be designed in the CMYK colour models unless specifically requested otherwise, or unless chosen by the designer at their discretion. Adobe, Pantone or RGB colours can be requested at no additional cost.
5.4 The source file is Adobe Illustrator CS3. Additional formats supplied (upon request) are: .EPS, .PDF, .jpeg, .gif and .png.
5.5 Notices of termination must be made in writing, which in this case shall be satisfied by fax or email. Notices of termination via email that are addressed to Blaze Concepts must be sent to the relevant email address.
